Whatever the legalities, Boulevard's various premises look to be losing a lot of business this summer with 8000 signatures already which will no doubt increase!

This has gone rather quiet - is there any more news about it?

They sell beers (and G&T´s) at their shop, 100 yards from the kiosk !

At the moment the Town Hall and Valls are having an arguement about who owns the actual kiosk.

Valls says that as they built and paid for it, it belongs to them. The Town Hall says that after 20 years, ownership passes on to the council.

So whilst this is ongoing, neither party can move forward, so it looks like they will be there during this year as well.

Smile Vall's Kiosk

All of the years we've payed PP a visit; which could be any time of the year. I have never seen a notable pedestrian blockage caused by the kiosk, Lets support this small but long established business... Mine & wife's vote has been cast in favour of keeping it...

Mayor facing legal action over Puerto Pollensa ice-cream kiosk » Balearics » News » Majorca Daily Bulletin

Quote:
The mayor of Pollensa, Miquel Ángel March, faces being taken to court because of the Gelats Vall ice-cream kiosk affair in Puerto Pollensa. He is specifically facing an allegation of malfeasance in having allowed the kiosk to remain open and not making good an order of eviction of the owners some two months ago.

..

The charge against the town hall states that because of its inactivity, Gelats Valls remains a beneficiary of the private and exclusive use of municipal public way and that it remains open to the public under highly favourable conditions compared to other businesses in the same area.
...

March says that he doesn't intend to execute eviction until a public tender for the kiosk has been called, despite the legal deadline for resolving challenges having ended. "We believe that at the end of the month there will be the bases for the tender contest, and we want to coordinate one thing with the other."

Pollensa mayor faces court case over ice-cream kiosk affair.

The Gelats Valls affair is heading for the courts.

The Gelats Valls ice-cream kiosk affair in Puerto Pollensa is arriving in the courts. The Inca court has accepted a suit being brought against the current mayor of Pollensa, Miquel Àngel March, his predecessor, Tomeu Cifre, and members of the ruling administration at the town hall as it was on 5 May 2015. They all face potential charges of malfeasance (abuse of public office).

**********

As for the significance of 5 May 2015, this was the date when the owners were awarded an extension for last summer but which did not extend to the current year. When the petition was raised, it was evident that the challenger to Gelats Valls was Grupo Boulevard, which operates the 1919 Café right next to it. The challenge has been based on the fact that the kiosk occupies the "public way" and so should be subject to public tender.

The town hall has not carried out the eviction order and has not initiated a tender.
