Default Planning permission - advice please

We are interested in a great apartment which has the addition of a super casita that has been built on to the private roof terrace. This we believe has been added without planning permission. It's a great place but it makes us a little nervous about pursuing it further. Any advice would be greatly received from anyone who may have experienced a similar problem and managed to overcome it.

Be very careful here. Ask to see a copy of the escritura or public deed and it will tell you on there what should be there, if there is nothing about the caseta then the caseta has been added without permission, if you are told otherwise then ask for the catastro number
which features on the escritura then take this to the town hall and ask them to check it. It may be that the construction has been there for more than eight years, if this is so then would need proof of this but it still needs to be checked that the town hall have not contacted the owner during the eight year period because if they have then it is a serious problem. I would go to a reputable lawyer and ask him to check this for you, of course you would have pay him but he would be an awful lot cheaper than the other option which will not go into.
