Post Community Charge

What can be done to make a neighbour in an apartment block pay the monthly community charges. Our community has not had any funds for 2 years from this neighbour and our sinking fund is sinking at an alarming rate !

Am no expert (and don't think we've had this problem in our community) but I have heard others with the same problem use the community management company to issue legal proceedings against the non-payer.

Hi there
We have this same problem every year with one owner. The debt has to be reported to the AGM (or call an egm) and shown in the minutes. Once the minutes have been issued the debtor has 30 days to object to the minutes, if he doesn't then he has accepted the debt and can be pursued in law. If he still doesn't pay then the Community President should instruct the Administrator to initiate the 'procesomonitorio' against the debtor. This requires no lawyer and is a sort of 'small claims court.
